Terms of Use

Effective 27 October 2026. These terms replace all earlier versions.

1. About These Terms

1.1 These terms apply to your use of kormax.com and its subdomains (the website). By using the website you agree to them. If you do not agree, please do not use the website.

1.2 The website is operated by Kormax Limited (New Zealand company number 7035593, NZBN 9429047026803), whose registered office is at 20 Kaimanawa Street, Kelvin Grove, Palmerston North 4414, New Zealand, on behalf of itself and its related companies, including Kormax, LLC in the United States and Kormax Pty. Limited in Australia. In these terms, Kormax, we, us and our mean those companies, and you means the person using the website and any organisation you act for.

1.3 The website is intended for businesses: engineers, buyers and others acquiring castings, engineering materials and related services for business purposes. If you use it on behalf of an organisation, you confirm you are authorised to accept these terms for that organisation.

2. Changes to the Website and These Terms

2.1 We may change, suspend or withdraw any part of the website at any time. We do not guarantee that the website will be available without interruption or free of errors.

2.2 We may update these terms by publishing a new version on this page with a new effective date. The version in force when you use the website applies to that use. A change does not apply to anything that happened before it was published.

3. Using the Website

3.1 You may use the website for lawful purposes connected with evaluating, specifying or buying products and services from Kormax, and for general engineering reference.

3.2 You must not:

(a) use the website in a way that breaks any law or infringes anyone’s rights;

(b) introduce malicious code, attempt to gain unauthorised access to the website or its systems, or interfere with its operation or security;

(c) submit false or misleading information, or impersonate another person or organisation; or

(d) copy or republish website content except as clause 7 allows.

4. Technical Information

4.1 Datasheets, composition and property tables, engineering articles, catalogues and other technical content on the website are general information. Values are typical or indicative unless stated as a specification minimum or maximum, and may depend on section size, heat treatment and casting or manufacturing method.

4.2 Technical content is not a specification, a design recommendation or engineering advice for a particular application. Before relying on any value, check it against the governing standard (for example the relevant ASTM, AS/NZS or EN standard) and the specification agreed for your order. Where the website and the agreed specification differ, the agreed specification governs.

4.3 Calculators and similar tools on the website, including the casting weight calculator, produce estimates from the information you enter. Any calculation is not a quotation and does not commit either party.

4.4 We take care to keep technical content accurate, but we do not warrant that it is complete, current or free of error. If you find an error, please tell us using the contact details in clause 14.

5. Enquiries, Quotations and Orders

5.1 Nothing on the website is an offer to supply. Information about products, materials, grades, processes, size ranges and lead times is a description of capability, which may vary by market. Some products and processes are offered in New Zealand and Australia only.

5.2 A quote request or other enquiry submitted through the website is not an order and does not create a contract. Any supply of goods or services is governed by the terms set out in or attached to our quotation or order confirmation, and not by these terms.

6. Drawings and Information You Send Us

6.1 You keep ownership of all drawings, models, specifications and other technical information you send us through the website or in response to it (your material). Sending it to us does not transfer any intellectual property rights.

6.2 We treat your material as confidential. We use it only to assess your enquiry, prepare a quotation and, if you place an order, to manufacture, inspect and supply it. We do not publish it.

6.3 To prepare a quotation or fulfil an order we may share your material with members of our foundry network, machining, inspection and testing providers, and freight providers, in each case only as needed for that purpose and subject to obligations of confidentiality.

6.4 If you and Kormax have signed a confidentiality or non-disclosure agreement, that agreement governs your material instead of clauses 6.2 and 6.3.

6.5 You confirm that you are entitled to send us your material. If any of it is subject to export controls, including the US International Traffic in Arms Regulations or Export Administration Regulations, you are responsible for complying with them. Please do not upload controlled technical data through the website forms; contact us first so it can be transferred by an approved method.

6.6 Personal information you provide is handled under our Privacy Policy.

7. Intellectual Property

7.1 The website and its content, including text, tables, images, drawings, video, software and the Kormax name and logo, are owned by Kormax or its licensors.

7.2 You may view the website, and download, print and share datasheets, catalogues and other documents made available for download, for your own engineering and purchasing purposes, provided you do not alter them or remove any Kormax attribution.

7.3 Any other copying, republication or commercial use of website content requires our written permission.

8. Links and Third-Party Services

8.1 The website may link to, or use, websites and services run by others, such as standards bodies, video platforms and form or analytics providers. We are not responsible for their content, availability or practices, and their own terms apply to your use of them.

9. Disclaimer

9.1 TO THE EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. EXCEPT AS SET OUT IN THESE TERMS, WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE WEBSITE OR ITS CONTENT, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT.

9.2 This clause is subject to clause 11.

10. Limitation of Liability

10.1 TO THE EXTENT PERMITTED BY LAW, KORMAX IS NOT LIABLE TO YOU, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY LOSS OR DAMAGE ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, OR FROM RELIANCE ON ITS CONTENT, INCLUDING ANY LOSS OF PROFIT, REVENUE, PRODUCTION, DATA OR OPPORTUNITY, OR ANY INDIRECT OR CONSEQUENTIAL LOSS.

10.2 This clause does not limit liability that cannot lawfully be limited, and is subject to clause 11. It does not affect any liability under a contract for the supply of goods or services, which is governed by the terms of that contract.

10.3 You agree to compensate Kormax for any loss or cost arising from a claim by a third party that your material infringes their rights, or that you sent it to us in breach of any law or obligation.

11. Market-Specific Terms

11.1 New Zealand. Nothing in these terms limits any right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot be excluded. If you use the website for the purposes of a business, the Consumer Guarantees Act 1993 does not apply, as permitted by section 43 of that Act.

11.2 Australia. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited, it is limited, at our option, to supplying the relevant service again or paying the cost of having it supplied again.

11.3 United States. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages. In those states, clauses 9 and 10 apply to the fullest extent the law allows.

11.4 If a clause in this section conflicts with any other part of these terms, this section prevails for users in that market.

12. Privacy and Cookies

12.1 Our Privacy Policy explains how we collect and use personal information, including information submitted through quote, contact, catalogue and newsletter forms. Our Cookies Information page explains how the website uses cookies and how to change your consent.

13. Governing Law

13.1 These terms are governed by the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the courts of New Zealand. This does not remove any right you have under clause 11 to rely on the law of your market.

13.2 If any part of these terms is found to be unenforceable, the rest continues to apply. Our not enforcing a provision is not a waiver of it.
